Thirty-six hours after the raid began, 17 people had been killed: two slaves, four townsmen -- including the Mayor of Harpers Ferry -- one Marine, and ten of John Brown's men, including two of his sons. John Brown and six of his men were taken to jail in Charlestown, Virginia. Five of the raiders escaped.

John Brown, still recovering from a sword wound, stood trial at the Jefferson County Courthouse on October 26. Five days later, a jury found him guilty of treason against the Commonwealth of Virginia, of conspiring with slaves to rebel, and of murder.
