Medric "Cecil" Mills Jr., 77, (right) died after suffering a massive heart attack in a shopping center parking lot outside Washington, D. C. Mills' daughter Marie Mills said that herself along with several other people ran across the street to the firehouse across the street but the firefighters refused to help.

The head of Washington D.C.'s fire department broke his silence late Wednesday after an elderly man died last month when he suffered a heart attack in front of a fire house and nobody helped him.

Fire Chief Kenneth Ellerbe -- who personally knew victim Medric (Cecil) Mills, 77 -- said that the Lt. Kellene Davis will be disciplined, despite her attempts to slink away from the controversy by filing for retirement.

""There is nothing in our protocol that would prevent an employee from rendering aid to a person who needs [IT]," Ellerbe told NBC Washington. "Everyone who puts on the uniform takes an oath and is required to respond when called."
